Please read the text of this public offer carefully. If you do not agree with any of its clauses, you have the right to refuse to purchase digital products and use the services provided by the Seller.
In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as the CC RK), this document is a Public Offer. In accordance with paragraph 3 of Article 396 of the CC RK, making a payment by the Buyer on the Website constitutes an acceptance of the offer, which is equivalent to concluding an Agreement under the terms set forth below.

1. TERMS AND DEFINITIONS
•    Seller – Individual Entrepreneur Islambakiyev Sh.A., IIN: 910109301239, Almaty, Republic of Kazakhstan, Samal-2, Building 33A
•    Buyer – any legally capable individual or legal entity (resident or non-resident of the Republic of Kazakhstan) who has accepted this offer by paying for a digital product on the Website.
•    Website (Online Store) – the internet resource located at qazaq-esim.com, intended for the sale of digital products (eSIM).
•    Digital Product (eSIM) – a virtual SIM card profile (a digital voucher in the form of a QR code and associated settings) providing access to a prepaid mobile internet data package in the selected country or region.
•    Order – the Buyer's choice of a specific internet data package (country, data volume, validity period) on the Website and its subsequent payment.
•    Support Service – the official communication channel with the Seller for processing Buyer requests via the chat on the Website or the WhatsApp messenger at: +7 705 454 49 65.

2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to provide the Buyer with a Digital Product (eSIM) with the selected internet data package, and the Buyer undertakes to pay its cost in accordance with the current tariffs on the Website.
2.2. This agreement regulates exclusively the sale of digital eSIM profiles and available internet data packages. The Seller acts as a distributor/aggregator of international telecommunication platforms and communication networks.

3. AGREEMENT CONCLUSION AND ORDER PLACEMENT PROCEDURE
3.1. The Order is placed by the Buyer independently on the Website.
3.2. When placing an Order, the Buyer is obliged to provide a valid email address (e-mail) and contact phone number. The Seller is not responsible for non-delivery of the product if the Buyer specified an incorrect e-mail.
3.3. Moment of Concluding the Agreement (Acceptance): The Agreement is considered concluded and the offer accepted at the moment of successful online payment for the Order by the Buyer on the Website through the internet acquiring system.
3.4. Order Execution: The Seller is considered to have fully fulfilled their obligations at the moment of automatic generation and sending of the QR code (eSIM) to the e-mail specified by the Buyer or its display in the personal account on the Website.

4. PRICE AND PAYMENT PROCEDURE
4.1. Prices for eSIM tariff packages are indicated on the Website and are determined unilaterally by the Seller.
4.2. Payment is made in the amount of 100% in a non-cash form (on-line payment) by bank cards through the secure payment gateway Epay (JSC "Halyk Bank of Kazakhstan" / Halyk Bank).
4.3. A fiscal receipt (electronic receipt of the cash register machine) is provided to the Buyer in electronic form to the specified e-mail or through the payment system.

5. REFUND POLICY
5.1. Technical Compatibility of Devices: The Buyer is obliged to independently check, prior to payment, whether their smartphone supports eSIM technology, as well as ensure that the device is not locked to a specific carrier (no SIM-lock). The Seller places a list of supported devices on the Website, but the responsibility for verification lies entirely with the Buyer.
•    The Seller does not issue refunds or product exchanges if the Buyer's device does not technically support eSIM.
5.2. Impossibility of Return After Receipt: Due to the specific nature of digital products, a QR code is a unique encrypted access key to data traffic. From the moment the QR code is sent to the e-mail or displayed on the screen, the product is considered transferred for use, and the confidential information contained therein is considered disclosed.
•    A Digital Product (eSIM) of proper quality is not subject to return or exchange after the QR code has been sent to the Buyer.
5.3. Manual Profile Deletion: If the Buyer, after installing the eSIM on their device, manually deletes the profile from the phone settings, re-installation using the same QR code is technically impossible.
•    Manual deletion of the eSIM by the Buyer is considered a voluntary opt-out of the service. In this case, the Seller's obligations are considered fulfilled in full, and no refund is made.
5.4. Exceptions (Refund Conditions): A refund is possible exclusively if the eSIM profile is technically non-functional due to the fault of the Seller or the global operator (an error on the generation server), and this fact is confirmed by the Seller's technical support service, provided that this profile has not been activated on the device (traffic usage equals 0 MB).

6. LIABILITY OF THE PARTIES AND LIMITATION OF LIABILITY
6.1. Third-Party Communication Service: The Seller ensures the delivery of the digital eSIM profile for access to data networks, but is not the ultimate operator of the cellular infrastructure (cell towers).
6.2. The Seller is not liable for:
•    The quality of coverage, temporary outages in the networks of local or international cellular operators in the country where the Buyer is located.
•    Data transmission speed, if it is reduced by the communication operator under the Fair Usage Policy or due to terrain features/the Buyer being in shielded premises.
•    Incorrect smartphone settings made by the Buyer during eSIM activation.
6.3. In any event, the maximum amount of the Seller's aggregate liability under this Agreement (including any legal and claim expenses) is limited to the amount actually paid by the Buyer for the disputed Order.

7. DISPUTE RESOLUTION AND CLAIM PROCEDURE
7.1. The Parties undertake to resolve all arising disputes and disagreements through pre-trial negotiations.
7.2. In the event of claims, the Buyer shall send an appeal to the Support Service at support@qazaq-esim.com or to the Seller's WhatsApp chat.
7.3. The period for consideration of a written claim is 30 (thirty) calendar days from the date of its receipt by the Seller.
7.4. If an agreement cannot be reached, the dispute shall be referred to the judicial authorities at the place of registration of the Seller in accordance with the current legislation of the Republic of Kazakhstan.

8. CONFIDENTIALITY
8.1. By placing an Order, the Buyer gives their unconditional consent to the collection, storage, and processing of their personal data (Name, phone number, e-mail, technical parameters of the session) for the purpose of executing this Agreement in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection".
8.2. The Seller guarantees that the Buyer's bank card data is processed exclusively on the side of the Epay payment gateway (Halyk Bank) and is not accessible to the Seller.
